I have a member of staff who recently left an existing pension scheme before my staging date. Do I have to put them back into my automatic enrolment scheme on my staging date?
If the member of staff
- meets the age and earnings criteria
- left the pension scheme within 12 months of your staging date
and the scheme could have been used for automatic enrolment, then you can choose whether or not to put them into a scheme on your staging date.
If they left the pension scheme more than 12 months before your duties start date then you don’t have put them into a pension scheme until your re-enrolment date even if they meet the age and earnings criteria.
If the scheme couldn’t be used for automatic enrolment you will need to assess them on your duties start date and put them into a pension scheme if they meet the age and earnings criteria.
